Overview

This issuance rescinds DPM Instruction No. 4-23 and 8-72, "Granting of a Variation to Subsections 816.1, 870.1, 870.2, 870.5, 870.53(b) of Chapter 8, Career Service, of Subtitle B of Title 6 of the District of Columbia Municipal Regulations." DPM Instruction No. 4-23 and 8-72 provided the D.C. Fire and Emergency Medical Services Department (FEMS) flexibility regarding D.C. government hiring regulations and procedures in order to allow FEMS to fill a number of vacancies created by the departure of paramedics and emergency medical technicians. The Instruction also permitted FEMS to dispatch the newly hired paramedics and EMTs into the field without the delay commensurate with cross-training these individuals as firefighters as outlined in the regulations. As a result, the Instruction enabled FEMS to meet the immediate needs of the District of Columbia residents and visitors. This variance, issued on April 30, 2013, as DPM Instruction No. 4-23 and 8-72, is being rescinded because the conditions that gave rise to the variance no longer exist and its application was strictly limited to the period needed to complete the specific hiring needs of FEMS.

DPM Instruction No. 4-23 and 8-72 refers to rules regarding variances, which were previously contained in Chapter 4, Organization for Personnel Management, of Subtitle B of Title 6 of the District of Columbia Municipal Regulations (DCMR). On December 11, 2015, Chapter 4 was renamed Chapter 4, Suitability, and the rules regarding variances were relocated to Chapter 1, Human Resource Management, of Subtitle B of Title 6 of the DCMR. The rules regarding variances referenced in DPM Instruction No. 4-23 and 8-72 may now be found in 6-B DCMR § 104.
